Microsoft 365 Collection Terms
The terms for using Lex to collect from an organization’s Microsoft 365 — a firm’s own, or a client’s.
- 1. Who is involved
- 2. Under the firm’s direction
- 3. Approval and access
- 4. Ending access
- 5. The firm’s responsibilities
1. Who is involved
“The firm” is the law firm or legal department that has an agreement with us for Lex. “The organization” owns the Microsoft 365 being collected from; it may be the firm itself or the firm’s client. “We” are metaisle Inc. These terms are part of the firm’s agreement with us, and what Lex collects is firm content under our Data Processing Addendum.
2. Under the firm’s direction
We act as the firm’s agent, under the direction of its lawyers, in collecting for a matter. We use what we collect only for that matter.
3. Approval and access
Lex can reach an organization’s Microsoft 365 only after an administrator of that organization approves it in Microsoft. The access is the one shown on Microsoft’s approval screen. Lex only reads: it does not change or delete anything in the organization’s systems.
4. Ending access
The firm can disconnect the organization in Lex at any time. The organization can withdraw its approval at any time by removing the Lex application in Microsoft Entra. What was already collected stays with the matter until the firm deletes it.
5. The firm’s responsibilities
- The firm will collect only from an organization whose data it is authorized to collect, for a legitimate legal purpose.
- Collecting is not preserving. Lex does not place a legal hold; preservation remains the firm’s and the organization’s duty.
- Whether a collection’s scope is adequate for a matter is the lawyers’ judgment.
